1. Services description
SmartFlightSchoolPro provides an AI-powered chatbot for flight schools, lead capture and management tools, automated email and SMS sequences, flight operations management, analytics and reporting, discovery flight scheduling, CRM integrations, and customer support. Services are provided “as is” and may be updated or modified at any time.
2. Account registration
To use the Platform you must provide accurate, complete, and truthful information, maintain current contact information, be at least 18 years old, have authority to enter into this agreement, and comply with all applicable laws.
Account security: you are responsible for maintaining account security, must not share passwords or access credentials, are liable for all activity on your account, and must notify us immediately of unauthorized access.
Prohibited account uses: you agree not to create accounts for illegal purposes, violate laws, impersonate others, create multiple accounts to circumvent limits, use accounts for spam or harassment, automate access without permission, or reverse engineer the Platform.
3. Subscription and billing
Plans: Clear Prop ($199/month, 500 lead interactions), Solo Navigator ($447/month, unlimited interactions), and Checkride Ready (custom enterprise pricing). Prices are subject to change with 30 days notice.
Billing terms: monthly subscriptions renew automatically on the same date each month; annual billing is available with a 20% discount; you authorize automatic payment processing; failed payments may result in account suspension.
30-day money-back guarantee: available for new customers in the first 30 days, provided onboarding is completed and key features implemented. Refund requests must be submitted within 30 days and are processed within 5–7 business days. Refunds are not available after the 30-day period, for customers who did not complete onboarding, for service abuse or policy violations, or for subscriptions cancelled and reactivated.
Cancellation: you may cancel anytime from account settings; cancellation takes effect at the end of the current billing period; no prorated refunds for mid-month cancellations; data is exported within 30 days and deleted 30 days after cancellation.
4. Acceptable use policy
You agree not to use the Platform for:
- Illegal activities — violating laws, fraud, hacking, distributing malware, or IP infringement.
- Harmful content— harassment, threats, hate speech, obscene or violent content, or content violating others' rights.
- Spam and abuse — unsolicited emails or SMS, phishing or spoofing, unwanted marketing, or automated unauthorized contact.
- System abuse — circumventing security, denial of service, scraping, or reverse engineering.
- Data violations— collecting data without consent, violating GDPR/CCPA, or sharing others' data without consent.
Violations may result in immediate account suspension, loss of service without refund, legal action, and reporting to law enforcement.
5. Intellectual property
All content on the Platform — software code and algorithms, user interface and design, documentation, logos, trademarks, and analytics — is owned by or licensed to SmartFlightSchoolPro. You are granted a limited, non-exclusive license to use it solely to access the services for your own business purposes.
Your content: you retain ownership of flight school information, student and prospect data, configurations, and communications. You grant us a license to store and process your data, use it for service delivery, improve our services, and create aggregated, anonymized analytics. Feedback you provide about the Platform becomes our property.
6. Warranties and disclaimers
The Platform is provided “as is” without warranties of any kind. We do not warrant uninterrupted or error-free service, guarantee specific results, or warrant security or third-party services. We do not guarantee a specific number of leads, conversion rates, revenue, growth, or email deliverability — results vary based on implementation, configuration, and market conditions.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of liability
Except for indemnification obligations, neither party shall be liable for indirect, incidental, special, or consequential damages; lost profits, revenue, data, or business opportunity; damages exceeding the amount paid by the customer in the prior 12 months; or business interruption. Our total liability for any claim shall not exceed the fees paid in the 12 months prior to the claim. These limitations do not apply to indemnification obligations, gross negligence or willful misconduct, breaches of confidentiality, IP infringement, or liability that cannot be limited by law.
8. Indemnification
You agree to indemnify and hold harmless SmartFlightSchoolPro from claims arising from your use of the Platform, violations of these Terms or applicable laws, infringement of third-party rights, and negligence or misconduct, including reasonable attorneys' fees and court costs.
9. Confidentiality
Both parties agree to protect confidential information — trade secrets, source code, customer lists and pricing, technical documentation, and strategic plans. We may disclose information to employees and contractors who need it, as required by law, with your consent, to enforce these Terms, or in aggregated, anonymized form. Confidentiality obligations survive for 3 years after disclosure (or until information becomes public other than through breach).
10. Termination
We may terminate or suspend your account if you breach these Terms, violate the Acceptable Use Policy, engage in illegal activity, fail to pay fees, or abuse the Platform — immediately or with 30 days notice. You may cancel anytime; cancellation is effective at the end of the current billing period with no refunds for unused portions (except within the 30-day guarantee). Upon termination, your access is revoked, your data is retained for 30 days (and exportable), then deleted. Intellectual Property, Limitation of Liability, Indemnification, and Confidentiality survive termination.
11. Service level and uptime
We target 99.9% uptime, measured monthly. We may perform maintenance during off-business hours with advance notice when possible; scheduled maintenance is excluded from uptime calculations. The uptime target is not a guarantee, and emergency maintenance may occur anytime.
12. Modifications to terms and services
We may modify these Terms with 30 days notice for material changes (updated “Last Updated” date; continued use indicates acceptance; substantial objections may cancel within 30 days). We may update features, discontinue features with notice, introduce new features, change pricing with 30 days notice, and modify availability or performance.
13. Third-party services
Your use of third-party services is governed by their terms and policies. We are not responsible for their performance, and you assume all risks from them. The Platform may contain links to third-party websites we do not endorse or control; your use is at your own risk.
14. Dispute resolution

Before formal action, both parties agree to good-faith negotiation for a 30-day period.
15. General provisions
These Terms, the Privacy Policy, and any amendments constitute the entire agreement regarding the Platform and supersede prior agreements. If any provision is found invalid, it is severed and the remainder continues in full force. Failure to enforce any right is not a waiver. You may not assign these Terms without written consent; we may assign to successors. Neither party is liable for failure due to force majeure (natural disasters, war or terrorism, pandemics, government action, or internet disruptions beyond our control).
